What Issues Are You Facing?

Eminent domain is the power of the city or state to appropriate private property for public use. Condemnation is the process by which the appropriation is accomplished.

In a typical condemnation proceeding, the city decides it needs a given parcel of land. The affected landowners are notified. Negotiations are conducted to determine a fair value of the property.

If the parties are unable to reach a resolution, a lawsuit is filed and three commissioners determine the amount the city must pay the owner for the confiscated property. Either party can contest the determination.
